TERMS of SERVICE

SECTION I: GENERAL

Completion may take anywhere between 1-10 weeks depending on the nature of your request, communications, and work load. As such, orders may not be fulfilled on a FCFS (first come first serve) basis.PAYMENT
A minimum of 50% of the quoted price is due upfront. You must pay to completion—including any and all incurred fees during the commission process—prior to receiving the finalized artwork.DELIVERY
Completed artwork shall be delivered either by email, Vgen, or Discord once full payment is made—including any additional charges incurred throughout the commission process.FINAL PRODUCT & AFTERCARE SERVICES
You are receiving a digital product—original hand-drawn artwork solely by yours truly on digital media—in the form of a PNG image file, with an additional JPEG file for web use. In addition, you will have lifetime access to aftercare services free of charge when you commission me. These include signature and watermark adjustments, requesting other file types, and a one-time file loss recovery if for whatever reason you have completely lost the image file for the artwork.

SECTION 2: USAGE
As a standard, commissions immediately grant you "Personal Use Licensing". You are welcome to use artworks for personal art collections, social media profile pictures, social media profile banners, character profile galleries, desktop/tablet/mobile wallpaper or screensavers, as a reference for other artists, or give as a gift to your loved ones to use as such.Please provide proper credit in some way; you are welcome to tag me on social media and/or link my website.You may NOT crop off or remove my signature (does not apply to cropping that occurs when making into a profile picture, banner, or thumbnail), please refer to my aftercare services in section 1.You may not use artwork for any means of profit or promotion involved with money—successful or not—without paying for the proper monetization or commercial licensing.Regardless of licensing, you may not under any circumstances use my artwork for the following:
✽ minting artwork as Non-Fungible Tokens (NFT)
✽ feeding artwork to any dataset for the purposes of training any artificial intelligence software

SECTION 3: WIPS & REVISIONS
This section does not apply to Surprise/Skeb style services.You will receive no less than 2 WIP updates; the initial rough sketch, and the beginning of the shading/rendering phase. You may request any necessary adjustments for each milestone update, otherwise I will proceed to the next phase.Additional fees may incur for any drastic changes. You will be made aware of this clearly, I will not proceed with the changes without your knowing consent to the additional charges.

SECTION 4: ARTIST-CLIENT RIGHTS
THE CLIENT (you) reserves the rights to:
✽ cancel at any time for any reason without disclosure of reasoning
✽ the intellectual property of your character(s), ideas, designs, etc.
✽ the privacy of your commission upon request
✽ personal use of the artworks
✽ the free lifetime Aftercare Services (see section 1)THE ARTIST (I, Leināʻala and aliases) reserves the rights to:
✽ decline and cancel a commission at any time without disclosure of reasoning
✽ block and blacklist any person for any forms of misconduct by any means, including but not limited to breaching these terms
✽ the sole ownership of intellectual property of the artworks itself
✽ the sole discretion of using my intellectual property to promote my services
✽ update prices, fees, forms, and services at any time for any reason
✽ update these terms effective immediately however I see fit, dated at the top

SECTION 5: CANCELLATION POLICY
You are entitled to cancel at any time for any reason without disclosure. Please inform me of your decision clearly as soon as you have made your decision.In turn, I reserve the right to cancel at any time for reasons such as, but not limited to;
✽ term violation
✽ misconduct without resolution
✽ if, for whatever reason, the commission cannot be completed

SECTION 6: REFUND POLICY
You maybe entitled to a refund under the following circumstances:
✽ cancellations made prior to the start of the commission
✽ cancellations by me as a result of not being able to complete the commission
✽ Vgen commissions that aren't delivered within the Vgen's Guaranteed Delivery TimeCommissions will not be eligible for a refund if you cancel after the commission had been started, or if I canceled due to no-response for payment completion after 7 consecutive days. Except for commissions made through Vgen, in which case no-response up until the final 24 hours of Vgen's Guaranteed Delivery Time will be canceled and may not be eligible for a refund.
